Industry Loses an Innovator

Richard John McCann A Patriot and True American Richard J. McCann unexpectedly died on Friday the 13th of August, 2010. Richard was born on December 16, 1957 in Kaiserslautern, Germany to Joseph & Evelyn McCann. They returned to settle in Spanaway, Washington in 1959, where he graduated from Bethel High School in 1976. Richard is survived by his wife Debbie; daughters Shelby McCann; Ashley & Josh Strauss; and his mother Evelyn. He was affectionately known as “Papa” to granddaughters Hailey and Rieley. Also surviving are his brother Michael (Jann), his sister Marguerite (Mike), and nephew Christopher. In addition Richard is survived by stepson Chesley III (Webber) and family. Richard is survived by many close friends who are like family, too numerous to count (you know who you are.) Richard was preceded in death by his father Joseph. Richard was a consummate second generation gunsmith and machinist, widely respected in his field. He was well known throughout the world for his expertise, knowledge, skill and abilities. Richard was an innovative rifle and knife designer. His MIRS rails system is widely used by American war fighters as well as assorted government agencies, NATO forces and law enforcement agencies throughout the free world. Richard was a life member of the NRA and Washington Arms Collectors (WAC). At Richard’s request there will not be a funeral service. A celebration of his life will be Sunday, August 22 at 11:00. It is being held at 320 – 127th St. East, Tacoma. Pot luck of your choice. Formal/business attire not allowed, casual attire by Richards’ request (wear what Richard would wear,) We will all miss his unique sense of humor; style; devotion and dedication. RICHARD HAS LEFT THE RANGE!

Richard’s wife Debbie will be assuming the helm of the business.

GSS Gear Announces New Breed Of Warrior

Global Supply Solutions, LLC announces its “Show of Pride Celebrating a New Breed of Warrior” to be held September 10-11, 2010 at the Virginia Beach Convention Center.

New Breed of Warrior will provide access to the latest in operational equipment from industry leading vendors. Attendees from the military and federal, state and local agencies will be able to review the latest equipment and identify “must haves” for operational success, directly with the manufacturers. In addition to presentations on the show floor, attendees will have the opportunity to participate in breakout sessions on a variety of topics ranging from equipment solutions to operational preparedness.

New Breed of Warrior is being held in partnership with the Navy League of Hampton Road’s Show of Pride and News Channel 3 (WGNT CW27). The Show of Pride honors and celebrates the military in Hampton Roads. Open to the public, this event will bring the public and military together to have fun and pay homage to our service members both here and abroad. All area commands in Hampton Roads are invited to participate. The event will feature a career fair for transitioning military and a special military marketplace featuring businesses with special offers and programs specifically for the military.

Highlights of both the New Breed of Warrior and Show of Pride include keynote addresses from prominent, high-ranking military officials. Also joining the show is Hampton Roads native and MMA star Brandon “The Truth” Vera. Vera is a former Air Force wrestler, two- time Pan-American Champion, eight time Grapplers Quest Champion, W.K.A. Muay Thai National Champion and Abu-Dhabi veteran.

So you are asking yourself, what makes this show different? Well, the biggest issue is that this will not be a completely closed event. Unlike most other trade shows, the New Breed of Warrior Expo will have an open day when the public can attend. Additionally, the show runs into the weekend. So, this may be a great reason for you to take a mini vacation to the Hampton Roads area.

WPRC Adds 7 Members

The Warrior Protection and Readiness Coalition (the WPRC) continues to build momentum and is pleased to announce seven leaders of the Operational Clothing and Individual Equipment industry have joined its unified voice for operational readiness and warfighter safety.

As of August 1, 2010, Bates Footwear, Benchmade Knife Company, Bluewater Defense, Brookwood Companies Incorporated, Duro Textiles, LLC, Outdoor Research and Polartec, LLC are all members of the expanding WPRC. These companies will join with WPRC counterparts in the effort to educate leaders on issues of warfighter protection and guarantee adequate funding for the development and procurement of first class Operational Clothing and Individual Equipment for American warfighters.

Alpha Dog of the Week – David H Brooks

Last week, the Colbert Report selected David H Brooks as the Alpha Dog of the Week. Conduct a web search for his name and you will see that no one seems to love Mr Brooks as much as Mr Brooks who is now infamous for his $100k belt buckle. The former head of defense contractor DHB is on trial for fraud and embezzlement.

Make Ready Forum

It’s not really a new forum, but it is a new look and feel for the popular EOTAC forum as it goes through a rebranding (not EOTAC, just the forum). All of the topics are still there but you will begin to see the breadth of info increase. Not being content with “just” on designing tactical clothing, the founder of EOTAC has a project in the works that Soldier Systems readers will like. More on that to follow soon. But in the mean time, he has re-launched the forum he previously started in preparation for the new project.

Berry Amendment Doesn’t Apply to DHS

DHS Ruling Erodes the Strength of the Berry Amendment

Did you know that the legislation named after Congressman E.Y. Berry in 1941, requires the Department of Defense (DoD) to use appropriated funds to procure items made only with domestic materials? The other restrictive agreements often confused with Berry are the Buy American Act, Trade Agreements Act, General Agreement on Tariffs and Trade, Free Trade Agreements, and Defense Authorization Acts and Appropriations Acts. However, the Berry Amendment is the most restrictive when it comes to clothing and textiles.

The original intent of the Berry legislation, as expected, was to protect the domestic clothing and textile industry. The concern today is that other Federal agencies fall only under the Buy American Act which is not as encompassing. Departments such as the Department of Homeland Security (DHS) are not specifically required by the Federal Acquisition Regulation to follow the Berry Amendment, even though this agency is as involved in national defense as the DoD. It gets more confusing because other agencies such as the GSA who procure for the DoD must adhere to the Berry Amendment – so if the DoD procures for DHS the amendment applies but not the reverse.

The question is “why is the Department of Homeland Security (DHS) excluded from following Berry Amendment acquisition guidelines?” As reported by James A. Morrissey, Washington Correspondent for Textile World, DHS has adopted as final their interim rule established last August 2009 which rejects the objections from the clothing and textile industry. The reason the industry objected to the ruling is that DHS has included the North American Free Trade Agreement (NAFTA) countries Mexico and Canada and for some reason Chile, as eligible for Federal contracts. Even though DHS said it received comments from 26 organizations and individuals and members of Congress suggesting that DHS comply with the Berry amendment, the DHS response was that the Homeland Security legislation “is not an extension of the Berry Amendment.” http://edocket.access.gpo.gov/2010/pdf/2010-13804.pdf

However, apparently not all DHS procurement officers are aware of this final ruling because according to United States Industrial Fabrics Institute (USIFI), the Transportation Security Administration (TSA) and the U. S. Coast Guard (both DHS organizations) procurement officials do include Berry Amendment requirements for purchases.

Again, according to Textile World, Representative Larry Kissell (D-N.C.), who guided the textile response to DHS, said that “any rule allowing unnecessary use of non-domestic parts will substantially undermine the job-creating capability.” Rep. Kissell is obviously concerned with the erosion of the Berry Amendment and the negative consequences for American workers and the industry itself.

Until such time as legislation can be introduced to bring DHS into the same compliance DoD follows with the Berry Amendment, companies in the clothing and textiles industry must be prepared to support ongoing efforts such as the Kissell amendment. Further, companies must invest in the time and effort required to understand the acquisition policies and procedures of the Federal government and especially the Department of Homeland Security.
