Blue Force Gear Enforces Its Trademark Rights

POOLER, GA, June 29, 2023—Blue Force Gear, Inc., an industry-leading manufacturer of innovative tactical gear, equipment, and accessories, has asserted its trademark rights and reached a settlement with Green Force Gear out of Finland. BLUE FORCE GEAR is the owner of numerous domestic and international trademarks, including: (1) BLUE FORCE GEAR®; (2) BFG®; (3) “BFG Reticle Design” trademark; and (4) its famous, widely-recognized, distinctive, non-functional and unique cross trademark, which is used in connection with a variety of products, including the TRAUMA KIT NOW!®, MICRO TRAUMA KIT NOW!™, and the HAMMOCK®.

Green Force Gear has agreed to permanently discontinue any and all uses of the infringing marks and designs in the United States, United Kingdom, Europe and throughout the world (subject to a phase-out period), and has agreed to resolve the matter pursuant to a settlement agreement and for an undisclosed monetary amount. The specific terms of the settlement agreement have not been disclosed.

BLUE FORCE GEAR is committed to protecting its intellectual property, including its trademarks patents and copyrights, and to ensuring that consumers are able to purchase genuine, non-counterfeit BLUE FORCE GEAR products.  Blue Force Gear’s General Counsel, Justin Charles Ward, stated: “We take the procurement and enforcement of intellectual property very seriously, both domestically and internationally.”

    Can someone explain how “Green Force Gear” somehow can violate a trademark that is “Blue Force Gear” or “BFG”? Does BFG hold the rights to “XXX Force Gear”?

    Or was this just a case of scaring a dude into switching?

    Also we’ve all had a PS controller in our hands, let’s not pretend BFG made that cross.

      If BFG needs to pull that kind of stuff, they don‘t need me as a customer, I guess.

        You might be able to tell the difference between companies named Blue Force Gear and Green Force Gear that do the same thing but that will cause confusion for some customers who aren’t as educated as you are.

          – quite likely not know about GFG/L4P
          – don‘t care to buy their innovative products and just buy BFG.

        BFG’s legal team is doing what it’s supposed to do. In order to maintain protection of one’s trademark, there needs to be evidence that the trademark owner is actively defending it. If there’s even a chance at passing the confusion test any legal team worth their salt is going to pursue a suit. Yes, it does make larger companies come across as bullies because they have the resources to aggressively defend their trademarks. But I think it’s fair to say that it’s less of a reflection of the ethics of the company itself and more of the limitations of US trademark law.

    Good products or not, they had it comming. My first impression of the company was ”Looks ok, but sure is embarassing they couldn’t come up with an original name”.
