Effective Immediately James Malarkey has been removed as CEO of X Products

Since inception X Products has been a strong advocate of 2A rights and Does Not support Mr Malarkey’s statements or any position that would suggest gun ownership is anything other than a right protected under the 2nd Amendment.

Mr Malarkey has been replaced as CEO by Dewey Akers, as acting CEO, effective immediately. Please refer all references for response to Mr Akers.

It is with sincere apology that X Products Senior Management finds it necessary to defend its position as a STRONG supporter of 2A Gun Rights.

The Senior Management has found it necessary to respond to this with our community of followers in a manner that removes any association with Mr Malarkey’s comments.

Mr Malarkey, or his comments, DO NOT reflect the position of X Products, its staff,or Industry Partners.

We have taken steps to insure we regain the respect of an industry that has been a support and source of growth for X Products and its staff.

X-Products Owner James Malarkey Thinks The Magazines He Sells Should Be Restricted By Law

James Malarkey is the CEO of X-Products, a company which manufactures drum magazines for AR-style firearms. His company is exactly the type of business that the anti-gun crowd goes after when they want to ban the sale of high capacity magazines.

Obviously, his ownership of a successful company in the firearms industry gives him a soapbox. When he talks, people are going to listen. Especially, someone like CNN. In a 2016 interview he made an interesting comment:

(CNN) – X-Products of Nashville, Tenn., makes 50-round drums that sell for up to $360 and fit onto AR-15s and other military-style rifles like the FN FAL. Some of the drums are “skeletonized” with a cage-style casing instead of solid metal, so the shooter can see how many bullets remain.

X-Products co-owner James Malarkey said he sells 10,000 magazines per year. But why would anybody want to own one?

“For the shooter, it’s fun,” he said. “You can go out, you can shoot multiple rounds, you don’t have to do a magazine change, and it’s bragging rights to your friends.”

Malarkey realizes that not everyone associates the gun drums with good times.  He admits that the general public might rest easier if government agencies develop a licensing system to make sure the owners are law abiding people.

“Instead of outright banning it, allow people to have some kind of licensing,” he said. “I think it would weed out a lot of crime.”

In response, X-Products issued this statement:

First and Foremost our company does not believe in licensing or restricting the sale of High Cap.

Mr Malarkey was interviewed about several items in a long discussion during Shot Show and CNN has taken two very out of context answers to multiple questions. Then they broke them up and spliced it into something that cleverly seems to favor some kind of support for their premise.

Mr Malarkey regrets having ever discussed/interviewed with CNN at all, and will not do so in the future. This is clearly not a position X Products believes is rational or viable.

We support the 2nd amendment rights of all citizens and are already saddled with bans of our products in multiple states now, we would not support any further limitations.

Sounds like something that could happen, right?

The problem is that just this week, James Malarkey doubled and tripled down on his “licensing system” scheme by laying out his proposal for a complex system of controls on the ownership of firearms on Facebook. Ironically, it would include the very magazines his company manufactures.

As you’ll see, it’s so in-depth that he had to have given this a great deal of thought. The CNN article hardly misquotes him. If anything, they brushed over his true feelings.

Malarkey refers to firearms ownership as a privilege. It’s not. Firearms ownership is a right, endowed by the Creator and secured in the Bill of Rights.

He sets out a set of hoops for citizens to jump through in order to own firearms. They are akin to the poll taxes and tests instituted by local and state governments to prevent certain segments of the population from exercising their constitutional right to vote.

I’m an ardent supporter of civil rights, including the right to bear arms. I’m not sharing Mr Malarkey’s commentary, or his wife’s to organize any form of boycott or outrage against him. My intent is solely to inform the public of his stance on your rights. Form your own opinion.

Former CEO and Executive Management of Defense Contractor, Wellco Enterprises, Inc., Pleads Guilty to $8.1 Million “Made In The USA” Marketing Scheme and Government Contract Fraud

GREENEVILLE, Tenn. – On February 15, 2018, the former President and Chief Executive Officer of Wellco Enterprises, Inc. (Wellco) and Tactical Holdings Operations, Inc. (Tactical Holdings), Vincent Lee Ferguson, 66, of Knoxville, Tennessee, pleaded guilty to conspiracy to commit wire fraud.  Wellco’s former Senior Vice President of Sales, Matthew Lee Ferguson, 41, of Geneva, Illinois, and former Director of Marketing and Communications, Kerry Joseph Ferguson, 36, of Houston, Texas, also pleaded guilty to conspiracy to commit wire fraud.

Wellco’s former Vice President of Government Contracting, Neil Streeter, 55, of Warren, Massachusetts, and former Operations Manager, Stephanie Lynn (Ferguson) Kaemmerer, 45, of Knoxville, Tennessee, pleaded guilty to smuggling goods into the United States.

Sentencing has been set for Vincent Lee Ferguson, Matthew Lee Ferguson, and Kerry Joseph Ferguson for June 6, 2018, before the Honorable J. Ronnie Greer, U.S. District Judge.  Sentencing for Neil Streeter and Stephanie Lynn Kaemmerer is set for June 11, 2018, also before Judge Greer.  Conspiracy to commit wire fraud and smuggling goods into the United States both carry a maximum penalty of 20 years in prison and a fine of up to $250,000.  Each defendant was released pending sentencing.

According to information on file with the U.S. District Court, Wellco was a leading manufacturer and supplier of military footwear to the U.S. Department of Defense (DoD) and to civilian (commercial) customers for over 70 years.  From 2006 through 2012, DoD alone paid in excess of $138 million to Wellco for the supply of combat boots.  Wellco pioneered and patented the first practical method for molding and attaching a rubber sole to a shoe upper in a single operation.  During the Vietnam War, the U.S. Army adopted Wellco technology for the manufacture of its hot-weather boots for the jungles of Vietnam, a boot that became known as the “Vietnam Boot” or the “jungle boot.”   In May, 2007, in a deal involving approximately $22 million, Wellco was acquired by two investment firms, Golden Gate Private Equity, Inc. and Integrity Brands, Inc.  Wellco became a wholly owned subsidiary of Golden Gate’s portfolio company, Tactical Holdings.

In March 2006, Vincent Lee Ferguson was made President and CEO of Wellco.  At that time, he discussed with Wellco’s Board of Directors, his turnaround plan for the company to increase commercial sales and “aggressively pursue” sales to the U.S. government.  From December 2008 through August 2012, he conspired with his executive team to import military-style boots that were made in China into the United States and then deceptively market and sell those boots to DoD (and other federal departments and agencies), government contractors, and the general public as “Made in the USA” and as compliant with the Berry Amendment and the Trade Agreements Act (TAA).   The Berry Amendment prohibits DoD from buying clothing that is not grown, reprocessed, reused or produced in the United States.  The purpose of the Berry Amendment is to protect the viability of America’s textile and clothing production base.  The TAA provides that the government may acquire only “U.S.-made or designated country end products” and requires government contractors to certify that each “end product” meets applicable requirements.

By December 2008, Wellco was manufacturing certain military boot model uppers and insoles in China.  In order to conceal this fact, the conspirators required the Chinese manufacturing facility to include the American flag and “USA” on labels of certain boot uppers.  After two shipments of these deceptively marked boots were detained and seized by the U.S. Department of Homeland Security’s Customs and Border Protection, the conspirators ordered the Chinese facility to stitch tear-away “Made in China” labels in Wellco boot uppers.  After importation, the conspirators instructed Wellco factory workers in Morristown, Tennessee to tear out the “Made in China” tags prior to shipping the boots to government and commercial purchasers.

The defendants marketed and sold these Chinese-made Wellco boots as “Made in the USA.”  They also submitted false certifications to DoD and other federal agencies, and to government contractors that these boots complied with the Berry Amendment and TAA and met certain safety standards, including electrical hazard and blood-borne pathogen protections for U.S. troops.  For example, on August 15, 2012, the defendants submitted a signed “Certificate of Conformance” to a government contractor, representing that Wellco’s boot model S161 was “100% Berry Compliant” and “fully protective against Electrical Hazard,” even though the model was imported from China and not safety tested.  The boots were then supplied to troops stationed at Sheppard Air Force Base in Wichita Falls, Texas.   In total, Wellco sold at least $8.1 million of fraudulent boots.

This case was investigated by Homeland Security Investigations, Defense Criminal Investigative Service, Air Force Office of Special Investigations, General Services Administration Office of Inspector General, and Defense Contract Audit Agency.  Assistant U.S. Attorneys David L. Gunn and Timothy C. Harker represented the United States.

This does not involve anyone currently with Wellco or Altama.

Jason Swazey Joins Kelty Tactical As Government Sales Manager

Over the past couple of years, Kelty Tactical has been introducing new products and Scott ring some wins so it’s great to see they’re bring in Jason Swazey to give Dan Eubank a hand. Jason comes on board as the Government Sales Manager, a role he is well suited for.

I’ve known Jason for over 15 years, going back to his time with Amron International. Next, he led Sandpiper of California, a pack brand found in military exchanges and elsewhere. For the past five years, he worked for ADS on the SOCOM Team, working with west coast-based SOF.

Jason tells me he’s looking to develop US made sewn goods focusing on Tents, Sleep systems, and Packs, as well as ancillary items like rescue ponchos, pack covers, and tent flies in all colors to include arctic white!

G T Distributors is pleased to announce that effective January 26th, 2018, 55% of the company’s stock has been sold to its employee’s retirement plan, through an Employee Stock Ownership Plan (ESOP). The Texas-based public safety equipment and uniform distributor’s 100+ employees will become beneficial owners through the ESOP.
This transaction gives employees a financial interest in the success of the business, making the positive bonds between G T Distributors teammates even stronger than they are today. It also rewards those who have played a critical role in G T’s success since the beginning.
