Sig Sauer Sues BATFE for Classifying Muzzle Brake as Suppressor

According to Sea Coast Online New Hampshire-based SIG SAUER has filed civil suit against the Bureau of Alcohol, Tobacco, Firearms and Explosives alleging they wrongfully classified a SIG-designed muzzle brake as an item “intended only for use” in producing suppressors. Specifically, BATFE determined that the SIG brake incorporated a monolithic baffle stack in its design. On April 4, 2013, SIG submitted the brake for BATFE examination which is described as 9.5 inches long and permanently attached with a weld to a 6.5 inch barrel, making the overall barrel length 16 inches. ATF responded by informing that the device was classified as a suppressor and that, “Welding it to a barrel does not change its design characteristics or function.”

SIG asked for a reconsideration, responding to the ATF on 6 September, 2013 in a letter offering evidence that sound meter testing proved the device amplified, not muffled sound,as well as evidence showing the device offsets and corrects recoil. Unfortunately, it seems the ATF stuck by their determination, responding in a February 21 letter stating that the device is a part intended only for use in manufacturing a suppressor.

Consequently, SIG filed suit claiming economic injury because suppressors are “subject to burdensome legal requirements” and “no market would exist for the device” whereas their muzzle brake “effectively reduces recoil and muzzle rise when a shot is discharged” making it “highly marketable to consumers and will generate profit.” SIG also asserts that despite their follow up with ATF, the agency did dispute its evidence that the device worked as claimed.

“If classified as a silencer, no market exists for the subject device given that it will not silence, muffle, or diminish the report of a firearm and yet it would still be subject to the burdensome requirements set forth above as if it really is a silencer,” Sig argues through Manchester attorney Mark Rouvalis and Virginia attorney Stephen Halbrook.

This suit comes on the heels of a recent suit by Innovator Enterprises against the ATF because it classified their Stabilizer Brake as a suppressor. U.S. District Judge John Bates

“In any agency review case, a reviewing court is generally obligated to uphold a reasonable agency decision that is the product of a rational agency process,” U.S. District Judge John Bates writes. “This is not a high bar,” he continues, “But in this case, ATF fails to clear it.” The Judge overturned the BATFE determination letter for teh device becuase it was based solely on physical characteristics rather than performance. He goes on, referring to the determination letter in his decision, writing, “contains hardly any reasoning, and makes no reference to prior agency regulations or interpretations that support its conclusion.” Instead, Judge Bates called the ATF letter a brief and informal document and “a non-binding statement of the agency’s position on whether the Stabilizer Brake is a silencer,” and “will not bear the force of law as applied in future classifications of different devices.”

Sounds pretty familiar.

Warrior Protection and Readiness Coalition Holds 5th Annual Day on the Hill

I’d say that it’s more important now than ever to work together as an industry. America currently enjoys an industrial base, unprecedented in history, that exists specifically to support the Warfighter. For that industry, this isn’t the time to take a back seat and hope for the best, but rather, to take steps to ensure an enduring role in supporting our nation’s most formidable weapon, it’s Warfighters. Many companies have already joined the Warrior Protection and Readiness Coalition or are involved in other, similar lobbying efforts. It’s imperative to organize in order to better raise awareness on Capital Hill of what strides have been made and what we can lose if the relationship between industry and Government is not properly fostered. The industry is feeling the effects of a changing demand for its products. For many years, the military has purchased equipment in a “feast” mode. All along, the industrial base has worked to develop better ways to protect our troops. Now that it would seem a “famine” has begun, we must not lose the momentum it has taken so long to build. Measures can be out into place to help soften the blows of Sequestration and to generate the next generation of protective equipment technology. One way is through the budgeting process and to do that requires Congressional support.

Now in its 5th year, the WPRC Day on the Hill brings together industry partners and key Congressional Leaders to share ideas and concerns regarding equipping our troops, now and in the future. We don’t want the protection of our troops to become an afterthought. The best way to ensure a viable industrial base is to proactively engage decision makers. Right now, the WPRC is the best, unified voice, our industry has.

Member companies of the WPRC will meet with Congress April 8th and 9th to recommend reform of procurement practices to improve U.S. manufacturers’ ability to develop and produce individual military equipment and clothing critical for mission readiness.

WASHINGTON, D.C. April 8th, 2014 – For the fifth consecutive year, member company representatives of the WPRC will travel to Washington to build awareness for the essential part of the U.S. industrial base that manufactures the personal equipment for the Armed Services, such as operational clothing, body armor, knives, boots, and optics, and advocate for the improvements needed to streamline government procurement practices and ensure the United States maintains a robust industrial base with key technical capabilities.

Acquisition reforms being recommended by the WPRC include:

  • Adhere to “Best Value” performance-based contracts for critical warfighter equipment and restrict the use of “lowest price technically acceptable” contracts.
  • Increase the visibility of warfighter equipment and clothing funding in Department of Defense budgets to sustain industry’s innovation investments.
  • Extend the Berry Amendment to the Coast Guard and TSA components of the Department of Homeland Security.
  • “The Warrior Protection and Readiness Coalition serves an essential role of advocacy and education on behalf of the innovative companies who manufacture equipment and clothing for our Armed Services,” said David Costello, Executive Director of the WPRC. “Our Coalition is comprised of the leaders in advanced US manufacturing, with capabilities that range from creating ballistic ceramic plates for body armor to the next generation of camouflage.     Darley Defense Awarded SOE Contract By DLA

    March 7, 2014 – Defense Logistics Agency (DLA) Troop Support, Philadelphia, PA has awarded W.S. Darley & Co – Itasca, IL a new Tailored Logistics Support Program contract for Special Operation Equipment (SOE). This contract includes a base period of two years with three options through March 6, 2019. This Indefinite Delivery, Indefinite Quantity contract holds a maximum total award amount of $10 billion.

    This is the second time Darley has been selected by DLA as an SOE TLSP contract holder. In addition, Darley was one of six companies awarded the Fire and Emergency Services Equipment (F&ESE) which was announced in November 2013.

    Products under the scope of the Special Operational Equipment contract include but are not limited to Survival Gear, Tactical Equipment, Eyewear, Diving & Maritime Equipment, Escalation of Force Equipment, Load Carrying Equipment, Expeditionary Shelters, Apparel, Communication Devices and Lifesaving-Search and Rescue Equipment.
