Huge News From McMillan Group International

Saturday, May 18th, 2013

When I hear that this company or that no longer wants to conduct commerce with the firearms industry I don’t freak out over it. Why? Because the market abhors a vacuum and things like this come out of it to fix the issue. This is great news because, rather than someone who is just in it for the money, an option for transactions run by someone who cares about our industry will be available. The less, “they” make money off of us, the less “they” can use it against us.

From Kelly McMillan;

Since the issue with BofA over a year ago, I have been working on a project to support businesses in the firearms industry. I am not quite where i wanted to be when announcing this project but it has been brought to my attention that there has been another corporate decision by a financial company to try and adversely effect our industry. Because I have been in the firearms industry for 40 years, and have been successful, I wanted to do something that would allow me to give back to the industry.

ATTENTION everyone using Quick Books for your accounting and using Intuit to process your credit card transaction. Just yesterday a close friend in the firearms industry was given notice that Intuit would no longer process their credit card transactions and they had one day to find another provider. I think we should assume that if they have any indication you do firearms transactions, they will cancel your services as well.

It was coincidence that I found out about this particular issue when I was in my friends office to tell him that I am starting a new business. After talking to thousands of people and hearing hundreds of stories about businesses in the firearms industry being denied financial services because of the industry we are in, it became clear to me that there is a real need to start developing a firearms industry supportive financial network. One of the most difficult services for us to get is merchant services. I have heard literally hundreds of stories about businesses being denied credit card processing because they company refused to handle firearms transactions.

So, though it is a little premature because I have a few things left to secure before I can proceed full speed ahead, it want to let everyone know I am developing a merchant services company that is partnered with a bank that is 100% behind our industry, and at services gateway company that shares our commitment. This is what I can promise every business owner out there,

” I will provide you with merchant services at the very lowest price possible, will stand behind you and you business every step. Our partner bank and gateway provider will support all of our industry businesses and you won’t have any fear that someday down the road you will get that call telling you your merchant account has been cancelled.”

The main reason for doing this is to provide the industry a service that they can count on, but we are confident that we can also save everyone money while doing it. We also plan to donate a percentage of our profits to firearms industry supportive organizations like the NRA, NSSF, SCI or other non-profit organizations.

Please pass the word. If you are in need immediately, we will work to get you set up asap. If you have service and want us to contact you when we are ready (1-2 months) you can message me with details.

CADEX Press Release Regarding Patent Rights for Rifle Chassis

Friday, May 17th, 2013

CADEX retains production and sales rights to its Strike Dual Rifle Chassis
design following the settlement of Ashbury suit

Quebec, Canada – May 16, 2013 – CADEX Inc. (CADEX Defence, Inc.) and Ashbury International Group, Inc. recently settled a nearly 18-month legal battle concerning modular sniper rifle stock design elements. Following the May 2 settlement, CADEX retains the production and sales rights to its existing Strike Dual Rifle Chassis design and will continue manufacturing and selling the dual rail rifle chassis system in the United States and globally.

CADEX announces the end to a patent infringement suit brought by Ashbury, who alleged that the earlier generation single rail CADEX Strike rifle chassis had infringed an Ashbury patent. CADEX ceased production of its single rail rifle chassis in mid-2012 when CADEX unveiled the Strike Dual Rifle Chassis design. During the litigation and settlement agreement between the two parties, Ashbury acknowledged that CADEX’s current Strike Dual Rifle Chassis design does not infringe the U.S. patent rights Ashbury holds on its single rail design. In the settlement agreement, Ashbury also agreed that CADEX will not be required to pay Ashbury any royalty or other license fees for CADEX’s continued manufacture and sale of its Strike Dual Rifle Chassis System and further agreed that CADEX’s distributors will not be required to pay any royalty or license fees related to such sales.

“CADEX intended to fight this case until realizing that there was a superior design – the CADEX Strike Dual Rifle Chassis – and that it was not infringing technology. Once CADEX realized they had a superior technology, that clearly did not infringe the Ashbury patent, CADEX had to make the best business decision as to how to settle the lawsuit”, said CADEX CEO Serge Dextraze. “CADEX’s priority was to make sure that CADEX can continue to move forward with its Strike Dual Rifle Chassis product line in the United States and globally, and CADEX has accomplished this goal. CADEX’s second priority was to settle the lawsuit over technology, which had become irrelevant to CADEX’s product line, and CADEX was able to do that inexpensively. It is already well known that the CADEX Strike Dual Rifle Chassis is the best product ever shown and offered on the market. With its recoil mitigation capabilities and attractive and unique style, we are not surprised the CADEX Strike Dual Rifle Chassis attracts that much attention. The CADEX Strike Dual Rifle Chassis is the most unique high-end product ever produced and available on the market.”

As a condition for settlement, Ashbury insisted that CADEX consent to a final judgment stating that Ashbury’s U.S. patent rights on the single rail design are valid and that CADEX’s older single rail chassis design infringed these U.S. patent claims. To entice CADEX’s consent to the judgment, Ashbury offered to settle for a single payment of $50,000 rather its previous demand of $325,000. The wording of the final judgment was carefully tailored to make it clear that only the CADEX Strike single rail design was capable of infringing Ashbury’s U.S. patent, which requires a single, unified or monolithic rail across the top of the chassis – this is not the case with the CADEX Strike Dual Rifle Chassis.

“The average patent case costs in excess of a million dollars to resolve through trial, making these nuisance value settlements attractive. To be clear, there was no trial or court hearing on the merits of anyone’s claims in this case. The resolution was entered into voluntarily. Happily, and with great relief for everyone, it is now clearly established that CADEX has, and will keep, all patents rights for the CADEX Strike Dual Rifle Chassis product line”, said Steven G. Hill of Hill, Kertscher & Wharton, LLP, who acted as lead counsel for CADEX during the case.

As of today, CADEX proclaims that both CADEX and its distributors will no longer be distracted by the now-settled litigation and instead may concentrate on the manufacture and sale of CADEX Strike Dual Rifle Chassis system. CADEX has designed and manufactured various chassis style stocks since 2005, which have been and continue to be used by multiple military and law enforcement agencies. Many of CADEX’s early generation design elements were also chosen for incorporation into the current US Army XM 2010 sniper weapon system.

CADEX’s current Strike Dual Rifle Chassis design features major enhancements that provide operators a solid, accurate chassis-type firing system that requires no tools to adjust the stock for length and comb height. The CADEX Strike Dual Rifle Chassis also features a unique ability to be disassembled for operator-level field maintenance. The keys to this capability are a two-piece top rail and a removable lower frame with magazine well: these advancements simplify disassembly without the need to remove either the rifle action from the chassis, the day sight or rear portion of the receiver rail. Since introducing its first sniper rifle chassis system, CADEX continues to develop improvements and innovative state-of-the-art rifle chassis designs. These are and will continue to be exemplified by the current CADEX Strike Dual Rifle Chassis.

Mike Noell Launches M3 “Investing In America” Private Equity Firm

Wednesday, May 15th, 2013

When I got this last night I was pretty stoked. I’ve known Mike a long time and its great to see that he’s back out here, in the mix with us.

FORMER CEO AND FOUNDER OF BLACKHAWK! PRODUCTS GROUP,
MIKE NOELL, LAUNCHES M3 “INVESTING IN AMERICA”

Industry Innovator Mike Noell Launches M3 “Investing in America”, a Private Equity Company for the Military, Law Enforcement, Private Security and Outdoor Markets

NORFOLK, VA (May 14, 2013) – Mike Noell, founder and former CEO of BLACKHAWK! Products Group and an industry leader in the design and manufacture of tactical, military, law enforcement and outdoor equipment, has launched M3 “Investing in America,” a private equity company with a mission to support new and growing companies with capital and management resources.
M3 “Investing in America,” a company founded on the same ideals that made BLACKHAWK! a household name, was created by Mr. Noell to help companies grow successfully.

20130514-223742.jpgA former U.S. Navy SEAL, Mr. Noell experienced his business epiphany when his military-issued, 100-lb. pack broke, ejecting gear. Quickly realizing the area was littered with mines and that luck was on his side, Mr. Noell promised himself that if he returned to the U.S., he would make gear that would not compromise soldiers or their missions.

Mr. Noell’s leadership and management skills were what took his small cut-and-sew start-up out of his garage in 1993 to a 65,000 sq. ft., 3.5 story corporate headquarters with manufacturing in 3 states and a global presence by 2008. During his tenure as president and CEO of BLACKHAWK!, Mr. Noell and his highly skilled and experienced team, were responsible for the acquisition of nine companies and brands and the development of some of the most innovative products in the industry today. Many of the products developed have become benchmarks within their categories, including the SERPA® holster, which is today a market share leader in law enforcement and civilian holsters; the Gladius® illumination tool which revolutionized the flashlight market with digital components and strobing capabilities, and the Integrated Tourniquet System (I.T.S.) which provides security, military and law enforcement with a quick-access, built-in tourniquet system to stem blood loss in limbs during combat situations.

After a seventeen year run, Mr. Noell had successfully positioned BLACKHAWK! for acquisition to ATK and in 2010 and Mr. Noell retired to spend time with his family. His decision to establish M3 “investing in America” provides a new pivotal role to pursue his passion and love of developing and growing companies by providing them with the productive and effective leadership skills, tools and resources to become brand leaders.

“I have always felt a deep respect and commitment to the men and women who serve our country and our communities. It is an honor to develop and produce products that can withstand any mission from the tortures of battle to the rigors of outdoor adventures,” Mike Noell, CEO of M3 “Investing in America” commented. “We are currently pursuing any potential relationships with like-minded companies.”

Protect The Force Inc. Enters into Agreement with Emergstat Technologies LLC to Promote Wound Treatment Technology

Wednesday, May 8th, 2013

Some very cool news from the guys at Protect The Force regarding a new lightweight bioactive wound dressing/pack from EmergStat Technologies LLC.

Protect The Force Inc., a wholly owned subsidiary of Mission Ready Services Inc. has entered into a consulting agreement with research and development company, EmergStat Technologies LLC. In return for an equity position in the Company, PTF will introduce and advance EmergStat’s wound management technologies to military and first responders worldwide.

Uncontrolled bleeding (hemorrhaging) continues to be the leading cause of preventable combat-related deaths and ranks second in civilian trauma incidents. EmergStat’s proprietary technology centers on a new lightweight bioactive wound dressing/pack which offers a plethora of potentially life-saving benefits including the following:

1. stops bleeding in less than two minutes at any point on the body;
2. easy application by a medic or the wounded soldier themselves;
3. prevention of infection via localized delivery of antimicrobials;
4. direct pain-relief through a controlled release of analgesics;

TNVC Supporting Our Second Amendment Rights

Wednesday, May 8th, 2013

We received this note from our great friends at TNVC who were at last weekend’s NRA Annual Meeting in Houston. Even though they are a night vision company, they understand how important our fundamental right to keep and bear arms is to America.

20130507-174616.jpg

As some of you were aware, we were down in Houston Texas attending the NRA show were over 70,000 showed up to show their support. An amazing show to say the least and we were honored to have NRA Executive Director Chris Cox stop by and talk about night vision. Kyle (our Director of Govy/Mil) is seen below explaining the finer points with some of our NV Gear.

Kyle also mentioned Gov. Perry showed up briefly and poked his head between the crowd to look at some gear. We wanted to talk with him, but the booth was incredibly crowded at that time.

We here at TNVC are extremely Pro-Gun and obviously have deep rooted beliefs in the 2nd Amendment. So you all know, each and every employee here at TNVC are also Lifetime Members of the NRA. We’re proud to support our constitutional rights and we hope each and every one of you are engaged in strong support.

Magpul Updates Status Of Move – Reveals Nothing…These Guys Are Good

Tuesday, May 7th, 2013

Magpul posted this update regarding the status of their move from Colorado following the passage of a slew of anti-firearms legislation including a new law that makes their flagship product, the 30 round PMAG illegal. Although it’s an update, they reveal no details. Very well played. There may be a future in politics for you after all, Magpul.

We’d like to thank the tens of thousands of visitors to our booth at the NRA show as well as the numerous posters here on our FB page for your support and for the generous invitations to relocate to your home states. While at the NRA show, we had the opportunity to speak with representatives from various gun-friendly states, including the Governor of Texas and his staff. We have some additional visits and meetings that will be taking place in the near future with the short list of remaining potential locations. Numerous preparations for executing the move while minimizing disruptions to production are already underway. As mentioned previously, we have already started moving some of our production out of CO. There are many factors at work in our decisions, including business climate, tax structure, legislative environment, regulatory burdens, culture, workforce, etc., and any decision that did not consider all these areas carefully would not only be ill-advised, but irresponsible to our employees, our customers, and the brand. We are eager to make more specific announcements as soon as we can responsibly do so without sabotaging our ongoing efforts and negotiations, and we appreciate your support and understanding until then.
