Battle Mug Acquired by TOT Holdings LLC

26 April 2016 – Time On Target Holdings LLC announced the acquisition of the Battle Mug brand today from their headquarters near Huntsville, Alabama.

The company will continue to market Battle Mug products and will be introducing an expanded line of high quality, USA Made products geared towards Veterans, First Responders, and Patriots.

Battle Mug is an iconic beer mug which features M1913 Picatinny rails and a crenulated base and is protected by four U.S. patents.

The company was created in 2009 by a U.S. Army Combat Veteran who was focused on creating military and firearm inspired lifestyle products crafted to the same high standards expected in Mil-Spec equipment.

Since then the product line has been expanded to include a full line of barware, and other items aimed at the modern warfighter.

Crye Precision Files Appeal in Recent Dismissal of Suit Against Duro Textiles

Yesterday, Crye Precision filed an appeal to Federal Judge Denise Cote’s ruling last week to dismiss Crye Precision’s lawsuit against Duro Textiles.

Revision Military Testifies Before US Senate Judiciary Committee On The Danger Of Counterfeit Products

Essex Junction, Vermont (April 27, 2016) – After recent successful actions against foreign counterfeiters, Revision Military, a world leader in protective eyewear solutions, was invited to share testimony with a U.S. Senate Judiciary Committee investigating the impact of foreign counterfeiting. Gregory Maguire, Revision’s Senior Director of Legal and Government Affairs, provided a comprehensive analysis of the current and future challenges facing American manufacturers, and outlined the dangers to consumers presented by illegal counterfeit ballistic products. Several recommendations were offered to the committee for consideration, including proposed steps for Federal government action that would strengthen efforts to curtail the sale of inferior counterfeit products.

“In recent years, despite forceful measures taken to protect our intellectual property, Revision has seen a dramatic rise in counterfeit products across multiple distribution channels,” said Maguire during his testimony. Maguire continued, “We expect that this trend will continue as our brand awareness and product penetration grows. As a small business, Revision is deeply concerned about the rise in businesses using and manipulating our intellectual property to produce counterfeit goods. The emergence of this activity requires ever-larger and more aggressive efforts to offset the effects that put significant strain on our resources.”

The U.S. Department of Defense maintains high standards for personal protective equipment. The U.S. Army uses these standards in the development and maintenance of the Authorized Protective Eyewear List (APEL)—a record of examined and tested manufacturers and products proven to satisfy standards for ballistic protection. Soldiers utilizing protective eyewear while on duty are required to select APEL-listed eyewear products. Revision eyewear, particularly the Desert Locust goggle, has been listed on APEL since 2007.

Maguire reiterated Revision’s commitment to cutting-edge protective products throughout its history, stating, “Revision Military was founded in 2001 with a singular mission: to produce cutting-edge protective eyewear that makes a real- world impact. The company is in the business of protecting those that put themselves in harm’s way for our safety. To this end, Revision has invested significant resources making state-of-the-art ballistic protection available to its customers. Counterfeits do not meet such standards, so these illicit products endanger the soldiers and law enforcement officers who unknowingly receive them, leaving wearers vulnerable to maiming and/or blinding, if not more serious injury, or death.”

Two prominent and illustrative encounters Revision has had with foreign counterfeit operations were detailed during the hearing. Most recently, in January 2016, Revision worked in conjunction with the Dearborn and Ohio County Prosecutor’s Office in Indiana to enact a sting at a trade show in Denver, Colorado. Additionally, in 2014, Revision submitted a bid for a Ukrainian eyewear tender for 1,500 protective goggles. Revision lost the tender to a company that provided counterfeit versions of Revision’s own Desert Locust product line.

These compelling examples were taken into consideration by members of the U.S. Senate Judiciary Committee, and provided a persuasive foundation for the following recommendations made by Revision:

  • Enable the Department of Homeland Security, namely U.S. Customs and Border Protection (CBP), to seize at the border imports that infringe U.S. design patents, and enable the recording of design patents with the U.S. Customs and Border Protection, IPR Enforcement Program.
  • Second, large online retailers need to be held more responsible and accountable for the sale of counterfeit goods on their websites.
  • Finally, federal law needs strengthening along the lines of jurisdictions, such as in Indiana, with regard to enforcement of intellectual property rights.
  • Revision Military will be working with the U.S. Senate Judiciary Committee and other government agencies to pursue these intellectual property reforms.     Court Dismisses Crye Precision’s Suit Against Duro Textiles

    On Friday, 22 April, 2016, Federal Judge Denise L. Cote published a ruling, granting Duro Textiles motion for summary judgement and dismissing with prejudice Crye Precision’s remaining claims against Duro Textiles, stemming from a lawsuit filed against Duro in early 2015. This is actually a second lawsuit although the initial suit was filed in late 2014 and withdrawn in early 2015.

    Specifically, the Judge dismissed three specific allegations in this suit; breach of contract, trade dress infringement and common law unfair competition arising from Duro’s printing of a camouflage pattern owned by the US Government.

    Crye Precision’s MultiCam licensing agreement was central to their claims against Duro. Duro last signed such an agreement with Crye in 2012 and once it had expired in 2014, and Duro began printing the Army’s OCP, legal actions commenced.

    Below is the paragraph 3(h), in question.

    According to New York law, this clause from the 2012 agreement is unenforceable due to reasons stipulated in the ruling. Furthermore, the judge ruled that it was too broad in scope. At face value, it seems like a pretty straightforward ruling by the court, until you consider that it could create a situation where the premise it is based upon fundamentally changes.  The full order, seen below, is quite detailed and worth the read.

    To be sure, this is a victory for Duro, but perhaps a bittersweet one. Duro was essentially a lone horse in printing OCP for the Army. Now, they are sure to see competition for this business in the future. What’s more, the Army may well lose control of the pattern it created for use in place of MultiCam. Whether the Army likes it or not, we may see commercial OCP, or really close copies, by Christmas.

    Here’s why. Much to the chagrin of those of us watching from the sidelines, the Judge’s decision does not declare whether MultiCam and OCP (Scorpion W2) are similar. Rather, the court is very clear that Duro is just printing what the Army paid them to print; namely, OCP and claims that the government can tell the difference.

    Judge Cote dismissed Crye Precision’s claim of trade dress infringement. The court’s ruling may well have set creating about an interesting situation. Consider this:

    The Government is the creator and only purchaser of Scorpion W2. It is a sophisticated consumer, as its creation of Scorpion W2 and its announced switch from MUTLICAM in 2014 evidences. Duro’s only sales of Scorpion W2 have been for the Government, specifically to Government contractors and subcontractors in the supply chain for the U.S. Army. These contractors order Scorpion W2 from Duro by name. Thus, while MULTICAM and Scorpion W2 compete in the same Government sales market, there is no likelihood of actual confusion on the part of the Government or its contractors.

    It’s the second and third order, or should I say “disorder” effects that will be interesting. For example, what if the consumer is no longer just the US Army but also commercial customers. Could that expanded consumer group tell the difference between these two patterns?

    This exact situation may be additional fallout from this ruling, and it may not just affect Crye Precision. By declaring the competition clause of Crye’s licensing agreement void, could printers, licensed or not, begin to make counterfeit versions of MultiCam, or for that matter OCP, consequence free?

    Although Judge Cote declared the provisions of Crye Precision’s licensing agreement too broad, you have to wonder how specific they would have to be to satisfy the court and protect the pattern(s). As far as I know, current licensees are under a newer 2014 version of the contract which may contain updated language that already addresses the court’s concerns and were signed under different circumstances than the long-standing agreements with Duro. It must be noted that this ruling by Judge Cote is specific to the situation with Duro.

    It is yet to be seen whether Crye Precision will appeal the ruling, but it doesn’t stop them from defending their IP on other fronts. Also, although many are concerned with license fees for the printing of both MultiCam and OCP. This ruling doesn’t address them. Regardless, the bottom line here is that Crye is going to have to sue the US Army if it wants to ultimately settle the MultiCam vs OCP question. We’ll keep you posted if we hear anything.
