Robinson Arms Complaint Against RRA, Bushy, Remington and Magpul

On 14 January, 2010 RDMI (Robinsom Arms) filed suit in US District Court for Utah against Remington, Bushmaster, Rock River Arms, and Magpul Industries based on alleged infringement of their patent.

Below is the actual suit taken from court records.

Robinson Arms Lawsuit Alleging Patent Infringement

This is the third patent related suit filed against Magpul this year. The initial suit came from A.R.M.S. over their dual aperture rear sight followed by Vltor in October alleging violation of their patent on the Modular Firearm Buttstock.

Reading through the filing I find one thing a bit odd. It claims that the ACR has been offered for sale, which still has not happened, particularly in the state of Utah. Based on this it seems to me that the case was brought a bit prematurely and was staged to have the most dramatic effect during SHOT Show unless it was intended to delay the release of the ACR into the market. But then why include RRA?

Rumors of Their Impending Demise are Greatly Exaggerated

Over the last few weeks I have repeatedly heard rumors concerning three separate companies that are supposed to be going out of business. In one case, the rumor is unsubstantiated and in the other two partially true.

1. Specter Gear is going out of business – Not True. They displayed at SHOT Show, their website is still up and, they are answering the phone.

2. Brigade Quartermaster is bankrupt – Partially True. True, they didn’t show up at SHOT Show and their booth remained empty, and true they did settle outstanding bills a little short. Sold to Ira Green, long time producer of uniforms and insignia for military and law enforcement, their main strong points are a solid reputation with their customer base going back over 30 years and a presence in military exchanges and clothing sales stores including kiosks and actual store fronts on several bases. If they can get the vendors worked out, expect them to come back strong.

3. Command Arms Accessories – Partially True. Currently undergoing a rebranding and are now called EMA Tactical.

Warrior Protection & Readiness Coalition

Several leaders in the Personal Protective Equipment industry have banded together to launch the Warrior Protection & Readiness Coalition (WPRC), an industry-led effort to ensure that US fighting forces are properly equipped and funded to execute their missions. For the first time, the manufacturers of individual equipment and protective clothing are combining their efforts to advocate for the resources needed to properly equip the US Warfighter. By advocating for fully funding an integrated set of clothing and equipment used by Soldiers, Sailors, Airmen and Marines, the WPRC will work to make certain that American Warfighters are supplied with superior gear and equipment.

The WPRC will work to ensure that there continues to be a robust domestic industrial base in place to support the permanent battlefield superiority of the US Warfighter. The coalition will focus on the legislative and policy development process, including advocating for adequate research and development of and full funding for superior Personal Protective Equipment for US Warfighters, as well as supporting policy initiatives that affect domestic manufacturers. Members of the WPRC are committed to working closely with the Program Managers of the Department of Defense to support their efforts to increase Warfighter effectiveness, survivability, mobility, sustainability and situational awareness and will advocate for integrated programs like Soldier-As-A-System.

The founding members of the WPRC include ADS Tactical, Darn Tough, Insight Technology, Integrated Wave Technologies, London Bridge Trading, New Balance, Otis, Pelican, Sperian, Surefire, Wiley X and W. L. Gore. Expect additional leaders in the Personal Protective Equipment industry to join as this effort gains momentum.
