SIG SAUER Statement Regarding Hartley v. SIG SAUER, Inc Class Action Agreement

SIG has released the following statement:

HARTLEY V. SIG SAUER, INC. CLASS ACTION AGREEMENT

Although plaintiffs have not proven their claims, SIG SAUER has reached an agreement to resolve a class action lawsuit alleging that P320 pistols manufactured prior to August 8, 2017, have the ability to fire when the pistol’s slide and barrel are in an unlocked condition. The plaintiffs in this lawsuit claim that the inclusion of a mechanical disconnector in the design of the P320 pistol after August 8, 2017, a feature which is also included in the free Voluntary Upgrade Program (VUP) provided to all owners of P320 pistols manufactured prior to August 8, 2017, prevents the P320 pistol from firing in this condition.

SIG SAUER denies plaintiffs’ claims. By entering into this agreement, SIG SAUER is not admitting that any of plaintiffs’ allegations have merit, and plaintiffs have not proven their claims. In fact, it is SIG SAUER’s position that the design of the P320 pistol – both pre-upgrade and post-upgrade – prevents the P320 pistol from firing in an unlocked condition. SIG SAUER has conducted extensive testing of both the pre-upgrade and post-upgrade P320 pistols to confirm its position that the pistol will not fire with the slide and barrel in an unlocked condition.

In late 2017, SIG SAUER implemented an upgraded design of the P320 pistol to enhance the safety and performance of its P320 model pistol. All P320 owners who purchased a pistol prior to the design change are able to have their P320 pistols upgraded through the P320 Voluntary Upgrade Program (VUP). The upgraded design and implementation of the VUP was designed to further enhance the drop safety of the P320 model pistol. Although the P320 pistol met and exceeded all U.S. safety standards, it was discovered during additional testing beyond those standards that in some cases, under very specific conditions, the P320 pistol could discharge if dropped at a specific angle. Additionally, as part of this design upgrade, a mechanical disconnector was added to the P320 pistol to enhance trigger feel and consistency, as well as to prevent a “dead trigger” condition when the trigger has been pulled with the slide retracted. Although this disconnector serves as a redundant safety against the pistol firing in an unlocked condition, it is not its primary function and is not necessary to prevent such occurrences.

The SIG SAUER P320 pistol continues to meet and exceed all industry safety standards, and it is safe to carry and use in both the pre- and post-upgrade versions, when handled in accordance with the operator’s manual. However, to avoid the uncertainty and high costs of further litigation, SIG SAUER has reached an agreement to resolve this case. The forms attached below describe the rights which current and past P320 pistol owners may have under the terms of this agreement. If this agreement is finally approved by the court, these individuals may be entitled to certain benefits, including continued availability of the P320 VUP free of charge, a lifetime warranty against specific kinds of damage to the firearms, and a potential refund of amounts previously charged to repair firearms or replacement of unrepairable pistols. Please review these documents carefully to determine whether you may be eligible to submit a claim for such benefits.

About Chuck Pressburg: SGM(R) Pressburg retired from the Army on 01JAN2017 with over 26 years of active service, mostly in Special Operations and Special Missions Units. After Infantry and Airborne Training in 1990, Chuck completed the Ranger Indoctrination Program and was assigned to the 1st Bn, 75th Ranger Regiment.

Chuck’s various assignments included:

• 10 years in the 75th Ranger Regiment including platoon sergeant of a 65-man strike force deployed to Afghanistan twice in 2001/2002. Chuck’s platoon was highly decorated for combat action receiving 10 Silver Stars and 11 Bronze stars with “V” during their first deployment.

• 24 Months rifle and sniper squad leader 82nd Airborne Division.

• 2 years Asymmetric Warfare Group (AWG) (Founding member, 1st Active Army unit member deployed to combat, Selection class #1, Operational Training Course (OTC) Class #1) Spending over 20 months in Operation Iraqi Freedom, conducting Small Kill Team (SKT) operations and Direct-Action raids in support of conventional and Special Operations Forces.

• 12 years, HQ USASOC performing various operational and staff tasks as required including a two-year assignment to the G8 section where Chuck performed Science and Technology R&D. While assigned to USASOC Chuck graduated from the Defense Acquisitions University’s Combat Developer’s Course and The Human Factors Engineering (MANPRINT) Course. Chuck spent several years assisting in material acquisition programs for SOF.

Navigating the changing currents of government contracting

>McRae Footwear learned quickly how to deliver goods to the world’s largest customer: the U.S. federal government.

In 1969, Victor Karam, a self-described “Yankee who loves the south,” transplanted from his native New England to join McRae Industries in an executive role. A cultured Bostonian of Lebanese descent, Victor had a master’s degree in journalism but ended up in an entirely different field: women’s shoes.

During the Vietnam War, Victor was drafted into the Army and stationed at Ft. Bragg, NC. He met his future wife during that time, and they decided they wanted to live near her folks. A head hunter connected Victor with Branson McRae, founder and CEO of McRae Industries in Mount Gilead. Branson offered Victor a position as a vice president. “Branson always said he liked to hire Yankees because none of the southerners understood production,” Victor laughs.

“Salary negotiations were interesting. Branson asked me my annual salary target. I told him I expected to match my current salary, which at that time was $15,000. ‘That won’t work,’ Branson said. ‘It’ll never be approved by the board, because I only make $12,000.’”

Despite the dip in pay, Victor was intrigued by Branson’s company and accepted the job. He thought he would move on after a year or two, but ended up staying for more than 45 years, eventually becoming president of McRae Footwear. He continues to serve on the board of directors.

Becoming a preferred contractor

Along with its knowledge of the government’s preferred mode of boot construction – vulcanized, direct molded sole — McRae had two other distinct advantages as a contractor. With fewer than 500 employees, the company qualified as a small business. And it qualified also as having a manufacturing plant in a “labor surplus,” or high unemployment, area. The Department of Defense “set aside” contracts for small businesses, and being labor surplus gave the company a price advantage over large businesses.

To supplement its U.S. government contracts, McRae made combat boots for other nations. For 25 years, the company has been a supplier of military footwear for the government of Israel. Over the years, McRae has also provided boots for military forces in Canada, Brunei, Great Britain, and Saudi Arabia.

“At the time, the design of McRae’s military boots was dictated by the government,” Victor says. “We didn’t have a lot of input. We didn’t have a shoe manufacturers association. The government gave us the patterns and told us how to make the boots. Requirements were so rigid that a slight defect could cause the military to reject an entire production lot of boots.”

“Branson made it clear that every government specification was to be met. ‘The longer you work here with me, whether you agree or disagree with the specs, you follow them,’ he said. ‘If you see something that needs to be changed, go through the proper channels to get it changed. If you can’t, don’t change it.’’

Specifications were – and still are – exacting and relentless, from cure time for rubber to the boot’s ability to withstand pressure. Government protocols are strictly enforced with McRae workers. Government inspectors frequently walked the floors of the McRae factory. “I don’t know that any of the inspectors that came through had shoe knowledge,” Victor says. “We had to teach them.”

If Branson felt a spec were wrong, however, he was not afraid to question it – through established government protocols. That involved meeting with federal representatives in Philadelphia to clarify requirements or, in one instance, challenge a boot recall.

Victor tells the story of an inspector sent in from Charlotte, NC. “This inspector tested and rejected a production lot of boots where a wrinkle was detected. But the regulations specified boots should be rejected if a horizontal wrinkle were found when tested between both thumbs. The wrinkle detected in this lot was vertical. We showed the quality controller in Philadelphia, and we won our case.”

Looking to the future

Today, about 90 percent of McRae’s military boot business is tied to government contracts. The company also makes commercial versions of its boots.

“Staying flexible and expecting the unexpected is all part of succeeding as a government contractor,” Victor says. “Demand may fluctuate, but our purpose never waivers: To help our troops fulfill their missions though durable and reliable footwear.”

Adding on: As boot orders from the U.S. government accelerated, McRae over time added on a second 100,000-square-foot facility in Troy, NC. This facility houses the company’s direct-attach injection-mold equipment for manufacturing current-spec military boots, along with lasting, finishing, warehousing, and shipping functions.
