Kryptek Outdoor Group Announces Final Judgement In Copyright, Patent, and Trademark Infringement Case Against Salt Armour, Inc., Alpha Defense, Inc. And Thomas J. De Sernia.

Defendants found guilty of willful infringement

BEAUMONT, TX, May 4, 2016. Kryptek Outdoor Group, LLC, a cutting-edge camouflage and apparel solutions company founded by U.S. Army veterans, today announced that the United States District Court for the Eastern District of Texas has rendered a Final Judgment and Permanent Injunction against Defendants Salt Armour, Inc., Alpha Defense, Inc. and Thomas J. DeSernia for infringement of Kryptek’s intellectual property, resolving a lawsuit filed by Kryptek on September 9, 2015.

Kryptek filed the lawsuit after Defendants ignored Kryptek’s multiple requests to cease and desist brazenly creating, offering for sale, and selling counterfeit copies of Kryptek’s camouflage patterns and products in an attempt to capitalize on the uniqueness and popularity the Kryptek patterns. Kryptek developed and released its innovative patterns and products in connection with the U.S. Army Camouflage Improvement Effort begun in 2011. Defendants further falsely claimed on their websites that the counterfeited patterns were their exclusive creations and tried to conceal their true origin by renaming them.

The Court’s Final Judgment and Permanent Injunction of March 29, 2016 found that Defendants had infringed on Kryptek’s copyrighted and patented camouflage patterns and willfully infringed on Kryptek’s trademarks, and ordered Defendants to pay One Million, Seventy-Five Thousand Dollars ($1,075,000.00) as damages for the infringement, plus attorneys’ fees and costs of court. The Court also permanently enjoined Defendants from further infringing activities.

“Blatant attempts to misappropriate and capitalize on others’ innovative creations do not garner a lot of respect in my book,” said Butch Whiting, CEO/Co-founder of Kryptek. “We are pleased that the Court put a stop to this and is holding the Defendants accountable for their actions. We also hope this judgment sends a clear signal of our intentions to vigorously defend against further theft of our creations moving forward, both domestically and abroad.”

The case is Kryptek Outdoor Group, LLC v. Salt Armour, Inc., Alpha Defense, Inc., and Thomas J. De Sernia, case number 1:15-cv-00348-RC, in the United States District Court for the Eastern District of Texas, Beaumont Division. Adaptive Sport Competition Empowers Disabled Veterans

Bridge II Sports hosts Valor Games 2016 sponsored by US Department of Veterans Affairs and MetLife

DURHAM, N.C. — May 3, 2016 — From May 23 to 26, disabled veterans and disabled members of the U.S. Armed Forces will compete at some of the most iconic sports venues in North Carolina during Valor Games Southeast. With a focus on empowerment, Valor Games Southeast is designed to draw participants into sports as a link to the community and improved health.

Bridge II Sports is proud to host the games for the fourth consecutive year, made possible by a grant from the U.S. Department of Veterans Affairs and support from several community and corporate partners, including a generous event sponsorship from MetLife. This is the second consecutive year MetLife has sponsored Valor Games Southeast, and the company will host the closing ceremonies at its Cary Global Technology Campus on May 26.

“MetLife has a long connection to the U.S. military, with our first policies insuring Civil War soldiers against wartime-related disabilities,” said Marty Lippert, Executive Vice President and Head of MetLife Global Technology and Operations, and Executive Sponsor of the MetLife Veterans Initiative. “Today, we’re continuing that commitment not only through the products we sell, but also by actively recruiting veterans for roles across MetLife.” Nearly 150 MetLife Cary associates are volunteering at the Valor Games.

“When you live with a disability, you are constantly told that you can’t do certain things,” says Ashley Thomas, executive director of Bridge II Sports. “Valor Games Southeast challenges our participants and the community to redefine disability and see the power and potential of sports.”

The Southeast games draw over 100 Veteran athletes to the Triangle for entry level and intermediate competitions in nine adaptive sports, including: cycling, power-lifting, archery, boccia, indoor rowing, sitting volleyball, air rifle, table tennis and shot-put. Demonstrations and trials of wheelchair basketball and kayaking will be offered as well.

Events will take place at the Dean Smith Center at the University of North Carolina at Chapel Hill, Cameron Indoor Stadium and K-Ville at Duke University and Lake Crabtree Park.

“It is incredible to see our athletes compete on the most hallowed sports ground in North Carolina, if not the country! You can see a change in their self-confidence as they step or wheel onto these courts,” adds Thomas. “These venues, the spirit of competition and the connection to the North Carolina community make a real difference for these military men and women after injury.”

Paul Howe Joins Panteao Productions

The role of Director of Training & Video Production is a new position at Panteao Productions created to assist with assessing new instructors, counsel and mentor instructors on video content, develop and maintain standards of conduct for instructors, develop an R&D Procedure for weapons videos, and work directly with the CEO of Panteao Productions on evaluating future video projects and overall company growth.

Paul Howe is a high-risk training instructor for Law Enforcement and Government Security who has evolved from the ranks. Beginning with a brief LE career in the late 1970’s, he served for 20 years in the U.S. Army, ten of those in Special Operations. Paul moved through the ranks and served as a Tactical Team Leader and Senior Instructor while assigned to Army Special Operations. During his tour in special operations he was involved in several combat actions. Upon retirement, Paul started CSAT-Combat Shooting and Tactics in 2000 as a top tier leadership and training company. Paul has appeared in nineteen Panteao instructional videos and a Panteao documentary on the Battle of the Black Sea, otherwise known as the true story of Black Hawk Down.

“I have worked with Paul since the start of Panteao Productions and he has always gone above and beyond towards helping the company. Martinsville, IN – April 29, 2016 – MTEK, manufacturer of high-performance ballistic products, announces they are now taking pre-orders for the latest development in head protection- The FLUX Ballistic. This helmet is a lightweight modular design that has an array of technological advancements in the ballistic helmet space.


The FLUX features an undercut shell geometry, which allows it to closely follow the natural contour of the head when compared to conventional “flared-out” helmet geometries. The lightweight shell is molded in-house using high-performance ballistic material, which is formed without any darts or slits in the material. It’s also 100% boltless, or bolt-through-less, meaning no drilled holes or perforations anywhere throughout the shell, and no hardened-steel bolts or fasteners. The finished shell weight of 1.1 lbs (2.2lbs total system weight) in conjunction with unique geometry, allows the FLUX Ballistic to be as light and comfortable as a bump helmet, while retaining the ballistic performance of much heavier systems.

“We could have released a conventional helmet 2 years ago, but decided to keep pushing the boundaries to avoid any compromise of the intended design. This required a significant amount of time and energy in order to further develop the processing techniques in order to take this to the next level”, explained MTEK Vice President of Business Development, Ryan Bowser.


The suspension and retention systems were made to support the ballistic shell in the best way possible. The Fluxliner is designed for the additional coverage area of the helmet’s unique shape and to make it as comfortable as possible for wear during prolonged use. Complementing the “Bolt-through-less” FLUX design, the retention system utilizes Inverse Clip, which allows the user to expeditiously change the retention system for removal, replacement or upgrade. The FLUX helmet uses the MAGPUL MLOK negative mounting space for accessory attachment points. This allows for some unique options for interchanging accessories (such as cameras and lights) between the helmet and rifle. Additionally, a spacer can be removed from underneath the accessory rail and replaced with upgraded ballistic covers. This furthers the helmet’s modular concept while ensuring maximum “rail-estate”.


“In the beginning, we asked ourselves how do we improve on some of the fantastic helmets that are already available? The answer we found was certainly not an easy one, but, in the end, has resulted in a lightweight, comfortable helmet that is configurable to many different situations and individuals.”

HASC 2017 NDAA Markup Includes Requirement For Berry Compliant Athletic Footwear

As you may know, DoD does a great job of adhering to the Berry Amendment, except when it comes to athletic footwear. While many look at the WWII-era law as protectionary, it was created to ensure a viable industrial base for textiles and other clothing, footwear and equipment items. The failure of DoD to follow Berry guidelines for athletic footwear is most apparent during Initial Entry Training where recruits are issued vouchers, which are traded for commercial running shoes at military exchanges.  As you can imagine, these shoes are made overseas.

For the past several years, Congress has been working with industry to offer viable American made alternatives to the military. The language in the National Defense Authorization Act has become more specific each year, and now hopefully, we’ll see this latest version become a part of the 2017 NDAA that the President signs into law later this year after it makes it through the rest of the hoops. Now, we’ve got both Saucony and New Balance offering Made in USA running shoes. Once this becomes law, I believe other brands will follow, bringing jobs back to the US.

Annual Department of Defense Funding Bill Includes Landmark Provision Requiring Department of Defense to Provide Berry Amendment Compliant Athletic Footwear to Recruits

Rockford, Mich., April 28, 2016 — Wolverine Worldwide (NYSE: WWW) today commended the House Armed Services Committee’s approval of legislation directing the Army, Navy, Air Force, and Marine Corps to provide Berry Amendment compliant athletic footwear to service members upon their initial entry to the armed forces. Currently, the Department of Defense provides a cash allowance to members for the purchase of foreign-made athletic footwear. This important provision was included in the annual National Defense Authorization Act (NDAA) and led by Armed Services Committee member Representative Niki Tsongas (D-MA.)

Since 1941, the Berry Amendment has required the Department of Defense to only purchase American-made and sourced clothing, textiles, foods, and other essential military items for our men and women in uniform. Until today, athletic footwear was not included in the Amendment. The purpose of the Berry Amendment is to ensure the United States is able to maintain viable industries for key military items should conflict break out and disrupt supply lines. This legislation helps support manufacturing jobs and sustains the domestic industrial base that currently builds the combat boots and military dress shoes for the United States Armed Services.
